A new and exciting opportunity for an senior clinical negligence solicitor to manage a full caseload of clinical negligence multi-track cases and on occasion, other personal injury claims. T! he caseload will include a significant number of large and/or complex cases.
The successful applicant will accordingly require a sound theoretical knowledge of the work and an ability to conduct cases including complex cases from beginning to end. The knowledge required to do this will normally take many years to acquire. Membership of the Law Society Clinical Negligence Panel and/or AvMA Panel will demonstrate this and is desirable.
This role will play an important part in the teams both locally and nationally in helping to achieve the team's objectives and in fostering team spirit. He/she will accept a share of responsibility for the success or failure of the team, and will assist in weekly review of new work on a national basis.
The successful applicant will be expected to participate in practice development and play an active role in developing the firms' presence in the Clinical Negligence Market.
Knowledge of CPR and Practice Direct! ion Clinical Negligence protocols, Personal Injury law and leg! al principles applying to Clinical Negligence.
Ability to draft:
- Case Summaries;
- Instructions to Experts;
- Witness Statements;
- Agendas for expert meetings;
- Court application notices and Pleadings;
- Costs estimates.
Ability to exercise judgment at every stage on case on relevance of new developments relating to breach of duty, causation, case value, limitation and funding and make appropriate decisions leading sometimes, but not always, to seeking supervision or Counsel's Opinion. Knowledge of rules and case law on Claimants under a disability.
Knowledge of complaints procedures as alternative to litigation.
Basic knowledge of Personal Injury Trusts.
Knowledge of LSC rules and practice! public funding of claims.
Knowledge of Access to Justice Act and case law on Conditional Fee Agreements and insurance.
Patience, sympathy, sense of humour as a basis of effective communication and management of client expectations.
Candidates will be qualified a Solicitor, Barrister or FILEX.
Travel to Bristol will also be required.
Salary Circa £51,000.
